Except as expressly provided above, this software and the Services are provided "AS-IS" and, to the maximum extent permitted by applicable law, SDG, Inc. and its suppliers disclaim all other warranties, express or implied, regarding the software or Services, disk and related materials including their fitness for a particular purpose, their quality, their merchantability, or their non-infringement, SDG, Inc. does not warrant that the Software or Services are free from bugs, interruption, errors, or implied warranties, so the above exclusions may not apply to you. In that event, any implied warranties are limited in duration to 30 days from the date of purchase of the Software. However, some states do not allow limitations on how long an implied warranty lasts, so the above limitation may not apply to you. This warranty gives you specific legal rights, and you may have other rights which vary from state to state.

Effective April 24, 2007: Returns must be received within 30 days of the purchase date with written documentation of the software's removal from all systems. A 15% restocking fee will be charged on all returns.

All warranties or guarantees given or made by SDG, Inc. with respect to the Software or Services (1) are for the benefit of the original purchaser/licensee of the Software only and are not transferable, and (2) shall be null and void if a purchaser/licensee breaches any terms or conditions of this Agreement.

Limitations of Liability and Damages

The entire liability of SDG, Inc. and its representatives for any reason shall be limited to the amount paid by the customer for the Software or Services, as applicable, purchased form SDG, Inc. to the maximum extent permitted by applicable law, SDG, Inc. and its licensors, distributors, dealers or suppliers are not liable for any indirect, special, incidental, or consequential damages (including damages for loss of business, loss of profits or investment, or the like), whether based on breach of contract, otherwise, even if SDG, Inc. or its representatives have been advised of the possibility of such damages and even if a remedy set forth herein is found to have failed of its essential purpose. some states do not allow the limitation and/or exclusion of liability for incidental or consequential damages, so the above limitation or exclusion may not apply.

The limitations of damages or liability set forth in this Agreement are fundamental elements of the basis of the bargain between SDG, Inc. and you. You acknowledge and agree that SDG, Inc. would not be able to provide this product on an economic basis without such limitations.

Software Version Limitations

It is illegal to make additional copies or otherwise duplicate the software by any other means (including electronic transmission) or to give copies to another person.

Single User versions of the software are intended to be used by one person or on one computer 'station' by multiple persons physically visiting said station. A Single User may be placed on the owner's personal computer and work computer as long as they are the sole user of the software. Installation of this software on a server or on a host computer that is accessed by multiple users is in violation of the terms of agreement for this version of the software.

Network and Terminal versions of the software are to be placed on a single server to be accessed by required personnel. License seats are purchased through Standards Design Group, Inc and user access will be limited to the number of purchased 'seats'.

It is within the customer's rights to create a 'backup' copy of downloaded software. This copy is to be used for backup purposes only and not to be given, copied, transmitted or sold to other persons or companies.
